By accessing or using Club Dewey ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Club Dewey is an AI-powered educational platform that creates personalized learning curricula based on your background, interests, and learning goals. The Service includes:

• AI-generated personalized learning paths and curricula
• Progress tracking and achievement systems
• An optional expert marketplace for connecting learners with subject matter experts
• Social features for sharing learning paths and collaborating with others

3. User Accounts

3.1 Account Creation

• You must provide accurate, current, and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You may create an account using email/password or through Google OAuth authentication
• You must be at least 13 years old to create an account

3.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not share your account credentials with others
• You may not create multiple accounts to circumvent restrictions or fees

4. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Transmit any harmful, offensive, or inappropriate content
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or harm other users
• Violate any intellectual property rights

5. Content and Intellectual Property

5.1 Your Content

• You retain ownership of content you create or upload to the Service
• By using the Service, you grant us a license to use, store, and process your content to provide and improve the Service
• You are responsible for ensuring you have the right to share any content you post

5.2 Our Content

• All AI-generated curricula, learning materials, and platform content are owned by Club Dewey or our licensors
• You may use the Service and generated content for personal, non-commercial learning purposes
• You may not copy, modify, distribute, or create derivative works from our content without permission
• You may not use our content to train competing AI systems

6. Expert Marketplace

6.1 Expert Participation

• Experts may offer coaching and educational services through the marketplace
• Experts set their own rates and availability
• Experts are independent contractors, not employees of Club Dewey
• Experts are responsible for their own tax obligations

6.2 Booking and Payments

• All bookings and payments are processed through the Service
• We charge a platform fee (10% of expert earnings) for marketplace transactions
• Experts receive 90% of their earnings
• Refund policies are determined on a case-by-case basis
• We are not responsible for disputes between experts and learners

7. Subscription and Payments

• Some features may require a paid subscription
• Subscription fees are billed in advance on a recurring basis
• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• Refunds are provided at our discretion and in accordance with applicable law
• We reserve the right to change subscription pricing with 30 days' notice

8. AI-Generated Content

• Our Service uses AI (including OpenAI) to generate personalized learning content
• AI-generated content is provided "as is" and may contain errors or inaccuracies
• You should verify important information from AI-generated content
• We are not liable for any consequences resulting from reliance on AI-generated content
• AI models may be updated or changed, which may affect generated content

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

10. Disclaimers

• Service "As Is": The Service is provided "as is" without warranties of any kind
• No Guarantees: We do not guarantee the accuracy, completeness, or usefulness of any content
• Learning Outcomes: We do not guarantee specific learning outcomes or results
• Third-Party Services: We are not responsible for third-party services or content
• Expert Services: We are not responsible for the quality or outcomes of expert services

11. Limitation of Liability

To the maximum extent permitted by law, Club Dewey and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any conduct or content of third parties on the Service
• Any unauthorized access to or use of our servers or data
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service

12. Indemnification

You agree to indemnify and hold harmless Club Dewey and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit, post, or transmit through the Service

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features in the Service.

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• You fail to pay required fees

13.3 Effect of Termination

• Your right to use the Service will immediately cease
• We may delete your account and data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending email notifications for significant changes
• Updating the "Effective Date" at the top of these Terms

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

15. Governing Law
